A steadily growing number of institutional investors are instructing their asset managers to integrate social and environmental criteria into their capital investment decision-making. But is the integration of sustainability criteria compatible with asset managers’ fiduciary duty? In order to provide legal clarification of this issue, in 2005 the United Nations Environment Programme Finance Initiative (UNEP FI) commissioned an expert opinion from the international law firm Freshfields Bruckhaus Deringer. The findings: integrating sustainability criteria does not constitute a breach of fiduciary duty. On the contrary,: as part of asset managers’ fiduciary duties, they should in fact take companies’ social and environmental performance into account, since in many cases such aspects also have a bearing on the risks of investments.
